Summary Trial & Strict Timelines

The Consumer Protection Act, 2019 is designed for swift justice. Unlike civil courts, it follows a summary procedure where "Natural Justice" is the guiding principle.

⚠️ Know Your Forum (2021 Revised Limits)

Before filing, you must choose the correct commission based on the Value of Consideration Paid (Not the value of goods + compensation claimed).

  • 🏛️ District Commission: Up to ₹50 Lakhs.
  • 🏛️ State Commission: Above ₹50 Lakhs to ₹2 Crores.
  • 🏛️ National Commission (NCDRC): Above ₹2 Crores.

Stage 1: Filing the Complaint (Sec 35)

Filing Complaint

A consumer can file a complaint physically or electronically (e-Daakhil). No Advocate is mandatory.

  • 📌 Limitation (Sec 69): Complaint must be filed within 2 Years from the cause of action (e.g., date of defect/injury).
  • 📌 Fee: A nominal court fee (via Demand Draft) is required. (Note: No fee for claims up to ₹5 Lakhs).

Stage 2: Admission (Sec 36)

The Commission examines the complaint to see if it is fit for trial.

The 21-Day Rule

Under Section 36, the admissibility must be decided within 21 days. If not decided, it is "Deemed Admitted".

Notice (Sec 38)

Once admitted, notice is sent to the Opposite Party (OP) to file their version.

Stage 3: Written Statement (Sec 38(2))

This is the strictest stage in Consumer Law.

Strict Timeline
  • Statutory Period (30 Days): The OP must file their reply within 30 days of receiving the notice.
  • Extension (15 Days): The Court can grant only 15 days extra.
    Note: The Supreme Court (New India Assurance vs. Hilli Multipurpose) held that beyond 45 days (30+15), no delay can be condoned. The defense is closed.

Stage 4: Evidence & Findings (Sec 39)

Evidence is given by Affidavit (Sec 38(6)). No lengthy cross-examination unless permitted.

Testing of Goods (Sec 38(2)(c)): If the defect cannot be determined by eye (e.g., adulterated food), the Court sends a sample to a laboratory. The finding is based on this lab report.

RELIEF (Sec 39)
Refund, Replace, Compensation, or Punitive Damages.
DISMISSAL
If defect/negligence is not proved.

Stage 5: Appeals & Execution

Appellate Courts

If aggrieved, the battle continues upward.

  • ⚖️ Appeal to State (Sec 41): Within 45 Days. Requires pre-deposit of 50% of the awarded amount.
  • ⚖️ Appeal to National (Sec 51): Within 30 Days from State Order.
  • ⚡ Execution (Sec 71/72): If the loser doesn't pay, they face imprisonment up to 3 years or fine (Criminal Trial procedure).
